The company’s investment in music not only allows for new revenue streams through advertising and subscriptions, it also provides a direct connection to Amazon’s smart speakers: its Echo line of devices. Speiss said that can be a valuable planning tool for individuals and couples filing jointly – for which the threshold is $22.8 million.

Big tech companies have been proposing almost constant changes to the law since it passed, while on the other side privacy advocates push for even more teeth. But however the final law is written, companies are also working on compliance, which is clearly confusing and can also be costly.

Host Molly Wood checked in with Jessica Lee, a partner at the law firm Loeb & Loeb advising clients on data privacy regulations. She said some companies are plowing ahead while others are trying to remake things in their favor. The following is an edited transcript of their conversation.

Molly Wood: The law doesn’t technically go into effect until next year. Where are companies doing now in the move toward compliance?

Jessica Lee: I see two tracks. Because there is a lot of movement on the legislative front, some companies are directing their efforts at engaging in lobbying activities, whether on the state level or trying to push the federal government to pass federal privacy legislation, which in the ideal world for these companies would preempt California. Other companies are at least trying to get started understanding that they might have to pivot or change or update some of the specifics about how they implement.

Wood: What was the overarching goal? What does it require companies to do?

Lee: This is really a bill that focuses on regulating the collection and then the transfer of personal data. There is a definition of sale, so there is a lot of language around restricting the sale of personal data, and sale is defined very broadly. You and I might think of sale as giving data in exchange for cash or some other monetary value, this could be sharing, transferring or disseminating orally an electronic copy for both monetary consideration or other valuable consideration. This really impacts a lot of data sharing deals that aren’t really data broker deals, but they’re deals where data is provided and the recipient gets some value from having it. For example, being able to improve their algorithm. The definition is fairly broad, and I think the goal was really to lift the cover on what happens online, which does involve a lot of data sharing, and to require companies to make more prominent notice about the fact that they’re engaging that kind of data sharing and give consumers the option to opt out, to have information deleted, corrected etc.

Wood: The obvious example here is how Facebook is able to say truthfully that it does not sell user data. But that answer to that question of what happens to our user data is still extremely narrow, because lots of app developers and advertisers still have pretty unfettered access to that data. Is that the kind of loophole that this would try to close?

Lee: Yeah, that’s exactly right. Wood: Data is an industry. There are companies who essentially founded themselves on the idea that data would be their revenue stream. Do you think we are getting to the point where regulation might become a deterrent for data as a business plan?

Lee: I don’t know if it will be a deterrent, I just think the structure and the model of the plan will have to change. I think historically a lot of this has gone on behind the scenes and hasn’t been appropriately communicated to the consumer. You don’t see me, but I have quotes around appropriate because it’s really hard to communicate what happens online and what happens with data. It’s hard to do that in a privacy policy or notice. It’s hard enough to do it when you explain it one to one. How do you educate consumers on what happens with their information so that they can make educated choices about what happens? I think data-driven business moves forward, but what shape it takes and how that model looks I think is a big question mark.

“Those three guys have made some big contributions to what I’m going through now.”

In those workouts, Harris was weightlifting, running the 40, doing the broad and vertical jumps and shuttle run, among other things in preparation for his Pro Day, which took place on March 28, in Fargo.

“There’s a lot of things that go into a pro day,” Harris said. “You want to get good numbers for the scouts, so they can see where you’re at athletically.”

At his Pro Day, Harris said a total of 47 scouts attended the workout.

“There were a lot of people there,” Harris said. “It was nerve racking at first, but I was ready for the competition. It was fun.”

Harris would go on to bench 225 pounds 16 times, and he ran his 40 in 4.5. He also did his broad and vertical jumps, along with the agility drills, including the 20-yard shuttle run.

He also did some drills at his cornerback position.

Harris’ performances must have impressed some of the scouts.

“I did well on all of my agility drills,” Harris said. “I showed them that I can move. It was a challenge, but you have to mind your Ps and Qs all of the time. That’s why I work on my craft. I have to be ready for anything that comes my way.

“My agent told me I better set the bar high. I had to run better than a 4.6. That was good on my part.

Harris said his father has had a big impact on his training. Johnnie had a five-year NFL career, playing with both the New York Giants and Oakland Raiders.

“He’s helped a lot, teaching me the ropes as to how things are done in the NFL,” Harris said. “Having that by my side helps. He’s somebody I can turn to.”

Since his Pro Day, Harris hasn’t taken many days off because he knows there are no guarantees in life.

“I have to maintain, and keep working on my craft,” Harris said. “I don’t want to be rusty going into a training camp. I have to keep my body as good as it can be. I know what I’m capable of doing.

“The teams know that, too. Any teams that pass on me are going to regret it later on.”

Harris did say that a couple of teams have expressed interest in him, but he was at liberty to name them.

“My dream is to play in the NFL, and knowing that teams are interested in me is a good feeling,” Harris said.

After his junior season at UND, Harris was projected as a first-round pick on some draft boards, but he injured his Achillie’s heel during an off-season workout, and had to sit out his senior year with the Fighting Hawks.

How did that affect his draft stock?

“It dropped at first,” Harris said. “They doubted me and my ability to run, move and jump at a high level. Since my Pro day, I’m right there. I’m an elite player, so that opened some eyes for them.”

Now, it’s a waiting game for the draft to begin. He won’t be at the draft, which is in Nashville, Tenn.

He’ll either be in Hibbing or Dallas watching it on the television.

To that end, Harris isn’t too concerned about where or what round he is selected. He just wants the chance to play in the NFL.

“As long as I get drafted, that’s the main thing,” Harris said. “I’m excited, but I have to calm myself down. I am counting down the days for it to happen. I’m curious to see where I end up.

“It’s going to be nerve racking, but I want to find out where I go. If that happens, it will be a dream come true.”
